Terms of Service

1. Agreement to Terms
By accessing or using DirectBookings ("Service"), operated by DirectBookingHost ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
DirectBookings is a software-as-a-service platform that enables short-term rental hosts to build direct booking websites, accept payments, manage calendars, create legal waivers, and automate guest check-in flows. The Service is provided on a subscription basis.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. You are responsible for all activity that occurs under your account.
4. Subscription & Billing
The Service is offered at $9/month with a 5-day free trial. Payment is processed through Stripe. Your subscription renews automatically each month. You may cancel at any time — your access continues until the end of the current billing period. No refunds are issued for partial months. We reserve the right to change pricing with 30 days notice.
5. Acceptable Use
You agree not to: use the Service for any illegal purpose; upload content that infringes intellectual property rights; attempt to gain unauthorized access to the Service; use the Service to send spam or unsolicited communications; resell or redistribute the Service without authorization; interfere with the operation of the Service.
6. Your Content & Data
You retain ownership of all content you upload (property photos, descriptions, waivers, etc.). You grant us a limited license to host, display, and transmit your content solely to operate the Service. We do not sell your data to third parties. You may export or delete your data at any time.
7. Guest Data & Waivers
When guests complete check-in on your booking site, their data (name, email, IP address, signatures) is collected and stored on your behalf. You are the data controller for guest data. We act as a data processor. You are responsible for ensuring your use of guest data complies with applicable privacy laws.
8. Payment Processing
Payments from guests are processed through Stripe Connect. Funds are deposited directly into your Stripe account. We do not hold or have access to guest payment funds. Stripe's terms of service apply to all payment processing. Standard Stripe processing fees apply and are subject to change by Stripe.
9. Legal Waivers & Rental Agreements
The Service provides tools to create rental agreements and custom waivers, including optional templates. All templates and generated documents are provided as-is for convenience only and do not constitute legal advice or legal counsel. We make no representations or warranties regarding the accuracy, completeness, legal sufficiency, or enforceability of any template, waiver, or agreement created through the Service. You are solely responsible for reviewing, customizing, and ensuring all legal documents comply with the laws and regulations of your jurisdiction. We strongly recommend consulting a licensed attorney before using any waiver or agreement with guests. We expressly disclaim all liability arising from your use of or reliance on any template or document generated through the Service.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss of bookings, revenue, or data resulting from Service downtime.
11. Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. We are not liable for: any disputes between you and your guests; the legal sufficiency, accuracy, or enforceability of waivers, rental agreements, or any other documents created using the Service; any legal claims, damages, or losses arising from a guest or third party challenging the validity of your waivers or agreements; loss of revenue due to Service downtime; any indirect, incidental, special, or consequential damages. Our total aggregate liability is limited to the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless DirectBookingHost from any claims, damages, or expenses arising from: your use of the Service; your content; disputes with your guests; your violation of these Terms or any applicable law.
13. Termination
We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon cancellation, your data will be permanently deleted.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved through binding arbitration in California. The prevailing party is entitled to recover reasonable attorney's fees.
